  • The Company is responsible for the Group’s natural gas trading and marketing activities in North America, including:
  • Purchase of wellhead, pipeline, regasified LNG, and Shale natural gas produced or owned by the Group or by non-affiliated suppliers;
  • Marketing and trading of wholesale US power including the optimization of power assets owned by other TotalEnergies affiliates.
  • Marketing and sales of natural gas supplies to utilities, power plants and other wholesale customers:


PURPOSES

  • Compliance with all applicable regulations and rules regarding the trading activities of the Company.
  • Continual internal compliance assessments of trading activities.
  • Submission of periodic compliance reports to senior management.
  • Maintenance of all required compliance documentation on a current basis.
  • Effective and efficient management of regulatory and other external inquiries and investigations regarding trading activities.
  • Achievement and maintenance of a high level of knowledge and awareness of regulatory and compliance requirements by Trading, management and other Company staff.
  • Management of LNG liquefaction and regasification terminal capacity, storage capacity and transportation capacity to secure and optimize natural gas flows in North American markets;
  • Wholesale physical and financial natural gas trading to optimize the Company’s sale and purchase portfolios, including arbitrage, balancing and hedging transactions; 
  • Marketing and sales of petcoke produced from the Port Arthur Refinery; and management of potential market and counterparty risks.

Atividades

Trading Compliance Director

  • Regulatory Compliance Controls - Work with Management, the Risk Control, Trading and Governance. departments and external resources to identify improvements to internal controls relating to trading and related activities that are regulated by federal, state,local governmental agencies, exchanges and ISO/RTOs.   Coordinate with departments to develop, initiate (where newly established), maintain, assess effectiveness and implement improvements for those internal controls.
  • Dodd-Frank Regulations - Serve as the primary Company contact for information related to Dodd-Frank.  Ensure Company compliance with, and employee awareness of, applicable Dodd-Frank regulations.  Answer questions from Management, Trading and other personnel relating to applicability of Dodd-Frank regulations to specific business activities.   Escalate awareness of updates, questions and issues as needed.  Interact with the CFTC, as necessary, with regard to the Company’s adherence to applicable Dodd-Frank regulations.
  • Act as the Chief Compliance Officer for the Company (NFA  registration).
  • Manage the regulatory aspects of TGPNA’s expansion into new markets and products.
  • Calculation, tracking and submitting of Company registration under Dodd-Frank and other regulations
  • Compliance Assessments - Conduct proactive compliance assessments of trading activities and strategies in order to ensure compliance with applicable rules and regulations by jurisdictional authorities (e.g., CFTC, FERC,NYMEX, ICE and ISOs/RTOs) as well as the internal policies of the Company, the Division and the Total Group.
  • Regulatory Monitoring - Monitor developments regarding new regulatory requirements and proposals, analyze the potential impact upon the Company’s trading activities and recommend necessary changes.
  • Internal Monitoring - Monitor Company and employee trading activities to ensure compliance with Company trading policies, including the Trading Compliance Code.
  • Training - Periodically train Company staff on federal, state,local regulatory and ISO/RTO compliance and other training requirements and TotalEnergie’s standards and policies and procedures related to trading compliance.
  • Culture of Compliance - Participate in Trading and Management meetings in order to advise on market compliance issues so as to facilitate the creation of a robust culture of compliance..
  • Coordination with Affiliates - actively collaborate with other TotalEnergies affiliates (including renewables, integrated power and TEAS legal) to ensure that all affiliates are aligned on regulatory reporting requirements.
  • Coordination with Legal Resources - Actively promote a collaborative relationship with TGPNA’s Legal staff and external counsel to facilitate strategic alignment and appropriate involvement of Legal in compliance matters, including the interpretation of applicable laws and regulations (proactively analyzing the effect of new or revised laws and regulations on the compliance program) and the management of government agency investigations and inquiries.
  • Documentation - Establish, maintain and update written regulatory compliance program documentation (e.g., desk reference) for assigned areas of responsibility and obtain necessary internal review and approvals for such documentation.
  • External Relationships - Develop strong external relationships, in conjunction with appropriate personnel from other functions, with counterparties and relevant industry and trade associations in North America in order to identify "best practices," improve the Company’s compliance program and enhance the Company’s compliance reputation in the industry.
  • Chief Compliance Officer (CCO)
  • The responsibilities of the CCO include coordinating the implementation of, and compliance with, the Prevention of Corruption Policy and the Prevention of Corruption and Compliance Program of TotalEnergies SE.


Perfil do Candidato

You are someone who possesses the following experience and credentials:

  • Knowledge of and experience with regulations and rules covering natural gas and power trading activities, including NYMEX, FERC,CFTC, ISO/RTO rules and regulations, with particular emphasis on compliance, control and legal matters.
  • Minimum of 10 years experience in regulatory or compliance matters, including a minimum of 5 years of demonstrated expertise in transaction monitoring and trading control.
  • Ability to understand and synthesize complex legal and regulatory concepts and translate for business stakeholders. 
  • Practical experience in the natural gas trading business, particularly in the US financial commodities markets (including futures, options and swaps). 
  • Excellent oral, presentation and written communication skills with the ability to apply these skills at all levels of the organization.
  • Strong interpersonal skills, including ability to adopt a variety of teambuilding and communication approaches to achieve desired results.
  • Strong work ethic and ability to work creatively to achieve identified goals.
  • Strong problem-solving skills with ability to see the next step and follow through on operational detail.
  • Demonstrate the ability to build consensus with diverse stakeholders.
